Cashtopia Terms and Conditions

1. Introduction Welcome to Cashtopia! These Terms and Conditions ("Terms") govern your use of Cashtopia's services, including our mobile and web applications, and any related products, websites, and services (collectively, the "Services"). Cashtopia is operated by Cashtopia LLC, a U.S.-registered financial technology company headquartered in Lexington, Kentucky, and a licensed Money Services Business (MSB) registered with the U.S. Department of the Treasury's Financial Crimes Enforcement Network (FinCEN).

By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.

2. Eligibility You must be at least 18 years old or the age of majority in your jurisdiction to use our Services. By using Cashtopia, you represent and warrant that you meet these eligibility requirements.

3. User Account and Security To access certain features, you must create an account with Cashtopia. You agree to:

• Provide accurate and complete information during registration

• Keep your login credentials secure and confidential

• Notify us immediately of any unauthorized use or breach of security

Cashtopia reserves the right to suspend or terminate your account if we suspect any unauthorized activity or violation of these Terms.

4. Services Offered Cashtopia provides a wide range of digital financial services, including but not limited to:

• Domestic and international money transfers

• Online shopping and e-commerce payments

• Bill payments and mobile top-ups

• Cryptocurrency withdrawals and exchanges

• QR payments and merchant services

• Virtual cards and wallet management

• Agent and merchant support

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice.

5. Fees and Payments Certain Services may incur transaction fees, service charges, or currency conversion costs. Fees will be disclosed before a transaction is completed. By using our Services, you agree to pay all applicable fees.

Cashtopia reserves the right to revise its fees at any time.

6. Prohibited Activities You agree not to use Cashtopia for:

• Illegal or fraudulent activities

• Money laundering, terrorist financing, or unauthorized money services

• Harassment, abuse, or threats toward others

• Attempting to reverse-engineer, hack, or compromise the platform’s security

Violations may result in suspension or termination of your account and may be reported to law enforcement authorities.

7. Identity Verification and Compliance We may require you to complete identity verification (KYC), biometric verification, and enhanced due diligence (EDD) in compliance with applicable laws and FinCEN regulations. You agree to provide accurate documentation and cooperate fully during the verification process.

FinCEN Compliance Requirements As a registered MSB, Cashtopia is required to:

• Develop and implement a written Anti-Money Laundering (AML) program designed to prevent money laundering and terrorist financing.

• Appoint a dedicated Compliance Officer responsible for oversight and enforcement of the AML program.

• Conduct regular risk assessments of products, services, delivery channels, and customer base.

• File necessary reports with FinCEN, including Suspicious Activity Reports (SARs) and Currency Transaction Reports (CTRs).

• Maintain transaction records and customer identification information as per Recordkeeping and Travel Rule obligations.

• Provide ongoing training to employees on AML obligations and regulatory updates.

Non-compliance with these obligations can result in regulatory action or termination of service.

8. User Data and Privacy Your privacy is important to us. Please refer to our Privacy Policy to understand how we collect, use, and protect your personal data. By using Cashtopia, you consent to the practices described in the Privacy Policy.

9. Intellectual Property All content, logos, software, and design elements on Cashtopia are the intellectual property of Cashtopia LLC or its licensors. You may not copy, reproduce, or use any part of our intellectual property without prior written consent.

10. Limitation of Liability Our Services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operations. Cashtopia is not responsible for:

• Losses due to failed or delayed transactions

• Unauthorized access to your account

• Service interruptions or third-party issues

• Funds sent to the wrong recipient due to user error

• Funds sent to scammers or fraudulent accounts

It is the user's responsibility to verify the recipient’s details and ensure legitimacy before completing a transaction. Cashtopia does not reverse payments made in error or compensate for losses caused by scams or user negligence.

Our total liability is limited to the amount of fees you paid to us in the past six (6) months.

11. Indemnification You agree to indemnify and hold harmless Cashtopia LLC, its affiliates, employees, and agents from any claims, damages, liabilities, or expenses arising out of your use of the Services or violation of these Terms.

12. Termination Cashtopia may terminate or suspend your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or Cashtopia.

13. Changes to Terms We may update these Terms from time to time. If we make material changes, we will notify you through the app, email, or our website. Continued use of the Services after such changes constitutes your acceptance of the new Terms.

14. Governing Law These Terms shall be governed by the laws of the Commonwealth of Kentucky, United States, with jurisdiction in the

courts located in Lexington, Kentucky.
